A Joint Parliamentary Committee (JPC) is expected to approve its report on the 130th Constitution Amendment Bill on July 17. The proposal could be discussed during the Monsoon session of Parliament.
The bill says that the Prime Minister, Chief Ministers, and other ministers may lose their office if they remain in judicial custody for 30 consecutive days in cases involving serious offences.
The committee is likely to keep this key provision in its report. However, it may also suggest safeguards to stop political misuse. It is also expected to recommend that the rule apply only to serious crimes, rather than to all criminal cases.
Union Home Minister Amit Shah introduced the bill in August last year. A 31-member JPC led by BJP MP Aparajita Sarangi has been examining the proposal.
The ruling alliance says the 30-day period gives enough time for an accused minister to apply for bail. Opposition parties disagree. They argue that removing a minister before a court conviction goes against the principle of natural justice.
Some opposition members are expected to submit dissent notes when the committee presents its report.
